Terms & Conditions

Last updated: 1 October 2026

Template notice. These terms are a starting point for a Malaysian web development service. Have them reviewed by a qualified person before publishing, and fill in the bracketed details with your registered business information.

1. About these terms

These terms govern the website development services provided by Forge Sales (business registration [Registration number], "we", "us") to you ("client"). By engaging us — by paying a deposit, signing a proposal or confirming by WhatsApp or email — you agree to these terms.

Where a written proposal or quotation states different terms, that document takes precedence over these general terms.

2. What we provide

We design, build and hand over an e-commerce website based on the package you choose:

  • Starter — storefront, catalogue, cart, WhatsApp-assisted checkout, basic SEO.
  • Business — everything in Starter plus customer accounts, payment gateway integration, order management and a basic sales dashboard.
  • Premium — everything in Business plus advanced customisation, promotional features, advanced reporting, priority support and agreed business-specific functionality.

The exact deliverables for your project are listed in your proposal. Anything not listed is not included, and is quoted separately if you later ask for it.

3. What is not included

The following are charged separately, paid by you, and are not part of the package price:

  • Domain name registration and renewal.
  • Web hosting and server costs.
  • Payment gateway setup fees, transaction fees and monthly charges.
  • Third-party software subscriptions, plugins, themes or licences.
  • Product photography, copywriting beyond what you supply, and translation.
  • Custom development beyond the agreed scope.
  • Any applicable taxes.

4. Payment

  1. A deposit of 50% is payable before work begins.
  2. The remaining 50% is payable before the site goes live on your domain.
  3. Custom development work is quoted separately and invoiced on agreement.
  4. Optional maintenance is billed monthly in advance and may be cancelled with 30 days notice.

Late payment beyond 14 days may pause work and, where the site has already launched, may result in the site being taken offline until the balance is settled.

5. Your responsibilities

To keep the project on schedule, you agree to:

  • Provide accurate business information, logos and product content in usable formats.
  • Respond to review requests within a reasonable time. Delays here extend the timeline.
  • Ensure any content you supply — images, text, product claims — does not infringe anyone's rights and complies with Malaysian law.
  • Hold any licences or permits your products require (for example food handling, halal certification, cosmetics notification).
  • Maintain valid accounts with your domain registrar, hosting provider and payment gateway.

6. Timeline

We give an estimated timeline in your proposal. It assumes your content is supplied on time and that feedback rounds happen promptly. We are not liable for delays caused by late content, third-party approval processes, or events outside our control.

7. Revisions

Two rounds of revisions are included in every package. A round means one consolidated set of change requests. Additional rounds, or changes to the agreed scope after development has started, are quoted separately.

8. Payment gateway approval

Payment gateway integration is included in Business and Premium packages, but approval is decided by the provider, not by us. Providers typically require a registered business, a business bank account and a website that meets their requirements. We prepare your store to meet those requirements and assist with the application, but we cannot guarantee approval. If an application is rejected, we will suggest alternatives. Where no gateway is available, WhatsApp-assisted ordering remains available.

9. Ownership

Once the final invoice is settled, you own the website design and content we created for you, along with your domain name (registered in your name from the start). We retain the right to reuse general code, components and techniques developed for your project in other work, provided your specific content, branding and customer data are never reused.

Third-party software remains under its own licence terms, which we will tell you about where relevant.

10. Maintenance and support

Optional maintenance is RM79 per month. It covers software and security updates, regular backups, small content changes and technical support during business hours. It does not cover new features, redesigns, content entry at volume, or repairs caused by changes made by you or a third party.

Without maintenance, the website remains yours and stays live, but you are responsible for updates, backups and security yourself.

11. Liability

We provide the website and services with reasonable skill and care. We do not guarantee specific sales results, traffic levels, search rankings or business outcomes — those depend on factors outside our control.

To the extent permitted by Malaysian law, our total liability for any claim arising from the services is limited to the amount you paid us for the project in question. We are not liable for indirect or consequential loss, including lost profit or lost data, where reasonable precautions were taken.

Nothing in these terms excludes liability that cannot be excluded under Malaysian law.

12. Termination

Either party may end the engagement in writing. If you terminate after work has started, the deposit is non-refundable and you pay for work completed up to that point. If we terminate without cause, we refund any amount paid for work not yet done and hand over completed files.

13. Confidentiality

We keep your business information, customer data and unreleased plans confidential. We do not publish a project in our portfolio without your permission.

14. Governing law

These terms are governed by the laws of Malaysia. Disputes are subject to the exclusive jurisdiction of the Malaysian courts. Before going to court, both parties agree to attempt resolution in good faith through discussion.

15. Changes to these terms

We may update these terms for future engagements. The version in force is the one published on this page when you engage us. Changes do not apply retroactively to work already agreed.
